Brello Health, LLC on its own behalf and on behalf of its affiliates and contractors (collectively “we,” “us,” or “our”) are committed to protecting the privacy of our visitors and users, and providing them with detailed information as to how their information is used and protected. This Privacy Policy describes how we collect and process your personal information through our website and mobile application (collectively, the “Platform”).
Your access and use of the Platform, any part thereof, or anything associated therewith, including its content (“Content”), any products or services provided through the Platform or otherwise by us, and any affiliated website, software or application owned or operated by us (collectively, including the Platform and the Content, the “Service”) are subject to this Privacy Policy unless specifically stated otherwise. Capitalized terms not otherwise defined in this Privacy Policy have the same meaning as set forth in the Terms and Conditions (“Terms and Conditions”). This Privacy Policy is incorporated into our Terms and Conditions. By using our Services, you are consenting to the practices described in this Privacy Policy and you agree that your personal information will be handled as described in this Privacy Policy. When you set up an account with us, you create a direct customer relationship with us that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to us, including but not limited to, your name, email address, shipping address, phone number and certain transactional information, which we do not consider to be Protected Health Information (“PHI”).
Certain health information may constitute PHI under the Health Insurance Portability and Accountability Act (“HIPAA”). This Privacy Policy does not apply to information collected from you if you register and log-in to the password-protected and secure portions of our Services, which are intended to be used by potential patients of independent healthcare providers for the provision of their respective professional services (the “Platform”). The Platform allows eligible patients to use certain Services related to the provision of the practice of medicine and other healthcare related professions. All information collected and stored by us or disclosed by you within the Platform is considered PHI and/or personal data and shall be governed by applicable state and federal laws that apply to such information, including HIPAA. To understand how we use and disclose PHI, you should review our Notice of Privacy Practices, which is available to users of the Platform within the Platform. The Notice of Privacy Practices (and not this Privacy Policy) also applies to Personal Information collected through our Services if specific symptoms or health conditions are also collected, as such information may be considered PHI under HIPAA. By accessing or using any part of the Service, you acknowledge receipt of the Notice of Privacy Practices.
Information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identified in accordance with applicable laws. For purposes of clarity, information you provide to us in order to register and set up an account on the Platform, including name, date of birth, username, email address, shipping address, and phone number, are not considered PHI.
While using our Services, you may provide us with certain information about you. We or our advertising partners also may automatically collect information through the use of cookies and other tracking technologies.
Personal Information that we collect through your use of the website and Services may include your IP Address, device ID, online identifiers (e.g., login credentials), and device location. Cookie controls. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.
Global Privacy Control. Note that the CCPA defines “sell,” “share,” and “personal information” very broadly, and some of our data sharing described in this Privacy Policy may be considered a “sale” or “sharing” under those definitions. In particular, we let advertising and analytics providers collect identifiers (IP addresses, cookie IDs, and mobile IDs), activity data (browsing, clicks, app usage, non-product identifying transaction data), device data, and geolocation data through our sites and apps when you use our online services, but do not “sell” or “share” any other types of personal information. Right to Limit Use and Disclosure of Sensitive Personal Information.
